Terms and Conditions Service Agreement

This Terms of Service Agreement (“Agreement”) is a binding legal contract between you and Youth With A Mission Guyana Limited (“YWAM Guyana,” “we,” “us,” or “our”), regarding your use of YWAM Guyana’s website located at http://www.ywamguyana.org on all platforms (the “Website”).
Carefully read this Agreement, the Privacy Policy and Disclaimer before using this Website. By using this Website, you agree to the terms and conditions of this Agreement and Privacy Policy. The Privacy Policy and Disclaimer are part of this Agreement and incorporated by reference herein. If you do not agree to any of these terms, please do not use the Website.
1. General Use of the Website — Permissions and Restrictions
YWAM Guyana hereby grants you a revocable, non-transferable, and non-exclusive permission to access and use the Website as set forth in this Agreement, provided that:
a. You agree not to alter or modify any part of the Website.
b. You will otherwise comply with the terms and conditions of this Agreement, and all applicable local, national, and international laws and regulations.
c. You agree not to impersonate any person or organization.
d. You agree not to harass any other user.
e. YWAM Guyana reserves the right to discontinue any aspect of the Website or services at any time.
2. Your User Comments and Conduct
a. You may submit comments, information, text, link, graphics, photos, videos, or other materials or arrangements of materials posted, uploaded, downloaded, or appearing on YWAM Guyana (collectively referred to as “User Comments”) to YWAM Guyana. You understand that YWAM Guyana does not guarantee any confidentiality with respect to any User Comments.
b. You agree that YWAM Guyana is not held responsible for any copyright infringement within User Comments
3. Copyright
It is not our intention to infringe on anyone’s copyright or facial recognition with the content (including but not limited to: photos, words, blog posts, music, references, links … etc) on our website. If you feel that we have infringed on a copyright you own or your privacy, you agree to:
a. Contact YWAM Guyana at privacy@ywamguyana.org in a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested (ex. Ask that the content be taken off the website)
b. allow YWAM Guyana 60 days to remove the content from the website before proceeding with any legal charges
4. Links to Other Websites
Our Site does contain a number of links to other websites and online resources that are not owned or controlled by YWAM Guyana.
YWAM Guyana has no control over, and therefore cannot assume responsibility for, the content or general practices of any of these third party sites and/or services. Therefore, we strongly advise you to read the entire terms and conditions and privacy policy of any site that you visit as a result of following a link that is posted on our site.
5. Typographical Errors
We are not responsible for typographical errors including but not limited to wrong prices/costs listed, wrong dates, or misinformation. YWAM Guyana retains the full right to change our prices, dates or information at any time without notice.
6. LIMITATION OF LIABILITY
IN NO EVENT SHALL YWAM GUYANA, ITS MANAGERS, BOARD MEMBERS, LEADERS, OR STAFF, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM YOUR ACCESS TO OR USE OF THE WEBSITE, CONTENT, USER COMMENTS OR THE PRODUCTS AND SERVICES AVAILABLE ON THE WEBSITE.
7. Indemnity
You agree to defend, indemnify and hold harmless YWAM Guyana, its managers, board members, leaders and staff, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Website; (ii) your violation of any term of this Agreement; (iii) your violation of any third-party rights, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Comments caused damage to a third party or to YWAM Guyana. This defense and indemnification obligation will survive this Agreement and your termination of use of the Website.
8. Termination Policy
a. You may terminate your use of the Website at any time. YWAM Guyana may terminate this Agreement, or suspend or terminate your access to the Website, at any time, for any reason. If YWAM Guyana suspects that you have violated any provision of this Agreement, YWAM Guyana may also seek any other available legal remedy. Your rights under this Agreement will terminate automatically if you breach any part of this Agreement. You remain solely liable for all obligations related to use of the Website, even after you have stopped using the Website.
b. YWAM Guyana reserves the right to decide whether Content or a User Comment is appropriate and complies with this Agreement for violations. Content on our YWAM Guyana website is solely at the discretion of YWAM Guyana. YWAM Guyana may remove such User Comment and/or terminate a User’s access for uploading such material in violation of this Agreement at any time, without prior notice and at its sole discretion.
9. Assignment
This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by YWAM Guyana without restriction.
10. Notice of Dispute
In the event of a dispute, you or YWAM Guyana must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute via email to: privacy@ywamguyana.org. You and YWAM Guyana will attempt to resolve any dispute through informal negotiation within sixty (60) days from the date the Notice of Dispute is sent. After sixty (60) days, you or YWAM Guyana may commence arbitration.
11. Changes to this Agreement
YWAM Guyana reserves the right to modify these Terms of Service at any time. We do so by posting and drawing attention to the updated terms on the Site. Your decision to continue to visit and make use of the Site after such changes have been made constitutes your formal acceptance of the new Terms of Service.
Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access the YWAM Guyana site immediately.
